1. Definitions
- "Bequestly", "we", "us", "our" — refers to Bequestly, a business registered in Malaysia, operating from Level 6, Wisma Central, Jalan Ampang, 50450 Kuala Lumpur.
- "Service" — refers to the educational programmes, document organisation support, and related content offered by Bequestly, including content accessed through our website at bequest.cyou.
- "User", "you", "your" — refers to any individual who accesses our website or engages with any of our programmes.
- "Content" — refers to all materials, text, documents, checklists, and educational resources produced and provided by Bequestly.
- "Agreement" — refers to these Terms & Conditions, together with our Privacy Policy and Cookie Policy.
2. Acceptance of Terms
By accessing our website or enrolling in any Bequestly programme, you confirm that you have read, understood, and agree to be bound by these Terms & Conditions.
Our services are intended for individuals aged 18 years and above. By engaging with our programmes, you confirm that you are at least 18 years of age and have the legal capacity to enter into this Agreement under Malaysian law.
If you are accessing our services on behalf of another person or organisation, you confirm that you have the authority to bind that person or organisation to these terms.
3. Description of Services
Bequestly provides general educational information and practical document organisation support relating to estate planning processes in Malaysia. Our three programmes are:
- Legacy Planning Orientation (RM 540) — a single educational session with plain-language materials.
- Estate Document Organisation Service (RM 2,000) — practical assistance organising personal records and documents.
- Comprehensive Family Legacy Programme (RM 4,300) — a multi-session programme combining education with hands-on record organisation and follow-up support.
Important limitation: Bequestly does not hold any professional licence. We do not provide legal, financial, estate planning, or any other regulated professional advice. Nothing we communicate, verbally or in writing, constitutes professional advice of any kind. You are encouraged to consult a licensed solicitor, estate administrator, or other appropriate professional for any personal decisions.
Services are available to clients across Malaysia, delivered in-person at our Kuala Lumpur office or via online video session.
4. User Responsibilities
When using our website or engaging with our programmes, you agree to:
- Provide accurate and complete information when submitting enquiries or enrolling in programmes.
- Use our website and content for personal, non-commercial purposes only unless otherwise agreed in writing.
- Not reproduce, distribute, or share our proprietary materials (including checklists, glossaries, folder systems, and binders) for commercial purposes.
- Not use our services in any way that is unlawful, harmful, or deceptive.
- Not attempt to gain unauthorised access to any part of our systems or infrastructure.
5. Intellectual Property
All content produced by Bequestly — including written materials, checklists, glossaries, folder systems, programme structures, and website content — is the intellectual property of Bequestly and is protected under Malaysian copyright law.
When you enrol in a programme, we grant you a limited, personal, non-exclusive, non-transferable licence to use the materials provided for your own personal estate organisation purposes. This licence does not permit reproduction, resale, redistribution, or use of materials for commercial purposes.
Any content you share with us during sessions (such as questions or discussion notes) remains yours. We do not claim ownership of personal information or documents you bring to sessions.
6. Payment Terms
Programme fees are payable in Malaysian Ringgit (RM) as stated at the time of enquiry and confirmed before enrolment. All fees are stated inclusive of applicable taxes unless otherwise noted.
Payment details and accepted methods will be confirmed in writing at the time of booking. We do not store payment card information.
Cancellation and refunds: If you cancel a session with at least five (5) working days' notice, we will offer a full rescheduling or a credit toward a future session. Cancellations with fewer than five working days' notice may be subject to a cancellation charge of up to 50% of the session fee. Bequestly reserves the right to reschedule sessions where necessary, with reasonable advance notice.
These terms do not affect your statutory rights as a consumer under Malaysian consumer protection legislation.
7. Service Delivery & Scope
Sessions will be delivered as described in the programme overview confirmed at time of booking. We will make reasonable efforts to maintain scheduled session times. Where sessions are rescheduled by us, we will provide reasonable notice and offer an alternative date.
The scope of each programme is as described on our website and confirmed in writing prior to enrolment. Additional sessions or materials beyond the agreed scope may be subject to separate fees, agreed in advance.
All documents and personal records shared or discussed in sessions remain in your possession at all times. We do not retain, copy, or store your personal documents.
8. Disclaimers
Our services are provided on an "as is" basis for general educational and organisational purposes. We make no representations that information provided in any session or material is complete, current, or applicable to your specific personal circumstances.
No professional advice: Nothing communicated by Bequestly in sessions, materials, or on this website constitutes legal, financial, taxation, or any other regulated professional advice. Bequestly is not responsible for any decisions made by you based on information or materials received from us.
We recommend that you verify any information relating to official Malaysian bodies, processes, or requirements directly with those bodies or with a licensed professional, as these may change over time.
9. Limitation of Liability
To the maximum extent permitted under Malaysian law, Bequestly's total liability to you in connection with any programme or use of this website shall not exceed the amount you paid for the relevant programme.
We shall not be liable for any indirect, incidental, special, or consequential losses arising from your use of our services or reliance on our content, including but not limited to loss of income, loss of savings, or adverse outcomes in estate or legal matters.
Nothing in these terms limits liability for fraud, wilful misconduct, or any liability that cannot be excluded by law.
10. Indemnification
You agree to indemnify and hold harmless Bequestly, its team members, and representatives from any claims, losses, or expenses (including reasonable legal fees) arising from your breach of these terms, your use of our services in an unauthorised manner, or any false or misleading information you provide to us.
11. Termination
Either party may terminate a programme arrangement by providing written notice. Where you terminate an enrolled programme, the cancellation and refund terms in Section 6 apply.
We reserve the right to refuse or discontinue service where there is evidence of misuse, abusive conduct toward our team, or breach of these terms. Sections 5, 8, 9, 10, and 13 of these terms survive any termination.
12. Confidentiality
We treat all information shared in sessions as confidential and will not disclose it to third parties except as required by Malaysian law or as described in our Privacy Policy. We ask that you also treat any Bequestly proprietary materials (checklists, systems, programme structures) with appropriate confidentiality and not share them publicly or commercially.
13. Dispute Resolution & Governing Law
These Terms & Conditions are governed by the laws of Malaysia. Any dispute arising from your use of our services will first be referred to informal resolution by contacting us at [email protected]. We will make reasonable efforts to resolve disputes within 30 days.
If informal resolution is unsuccessful, disputes shall be subject to the jurisdiction of the courts of Malaysia, in Kuala Lumpur.
14. General Provisions
- Entire Agreement: These terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Bequestly regarding your use of our services.
- Severability: If any provision of these terms is found to be unenforceable, the remaining provisions continue in full force.
- Waiver: Failure to enforce any provision of these terms does not constitute a waiver of that provision.
- Assignment: You may not assign or transfer your rights under these terms without our prior written consent.
- Notices: Formal notices should be sent in writing to our Kuala Lumpur address or to [email protected].
15. Changes to These Terms
We may update these Terms & Conditions from time to time. Material changes will be noted at the top of this page with a revised "Last Updated" date. Continued use of our website or services after changes are posted constitutes acceptance of the updated terms.
